A Blog About Intellectual Property Litigation and the District of Delaware

District Court Seal

I imagine all of our Delaware readers already know this, but the District of Delaware Bench and Bar conference starts tomorrow and runs through Friday.

The District of Delaware bench-and-bar is an excellent event that runs all day tomorrow (Thursday) and Friday, including an evening event on Thursday. It is the product of a huge amount of work put in by the District of Delaware FBA as well as many other attorneys, judges, and staff member, for which we are all thankful!

As we mentioned earlier this year, the Court has already issued an order modifying case deadlines that would otherwise fall tomorrow and Friday:

IT IS HEREBY ORDERED that all members of the court - District, Magistrate, and Bankruptcy Judges - will, to the greatest extent possible, cancel and refrain from scheduling court proceedings and filing deadlines on the two days of the Conference. Absent further order from the presiding judge in any particular matter, any filing or service obligation otherwise falling on September 21 or 22, 2023, is HEREBY MODIFIED to be Monday, September 25, 2023.

That said, if you are an out-of-town attorney, you may notice a decrease in responsiveness of your local counsel while most or all D. Del. IP attorneys attend the conference.

A Great Event

This will be the first post-COVID bench-and-bar for the District of Delaware, but as you can see from the agenda (attached below) it looks to be very worthwhile to attend for anyone who practices here.

In particular, the Litigation Finance break-out session with Chief Judge Connolly could be interesting (I imagine Mavexar may come up). The Patent Litigation Pitfalls session should be great as well—I often think back to some of my notes from similar pre-COVID sessions. It's really nice to hear judges explain their preferences (and, often, the reasoning) rather than guessing or submitting something the Court doesn't like.

All in all it looks like a wonderful program with many incredible speakers. We'll see you there!
